In a mutually consented divorce case after the Motion 2 date when both petitioners stick to divorce what time will be taken by court to pass the decree of divorce after motion 2 date.Preciously what is the approximate time gap in between motion 2 date and the date of grant order for decree of divorce .And whether after obtaining it both petitioners are free
Dr J C Vashista (Expert) 17 December 2013
1. It will be instantly, i.e., same day.
2. Of course both petitioners are free soon after obtaining MCD

Same Day Order of allowing Divorce is passed.

Decree may take a month, but parties are free to re-marry.

Yes, it is same day affair.
It is better to wait for least one month.

After completion of evidence formalities on the date of2nd motion, the court will reserve the orders to be pronounced on next hearing which may be in a couple of days or a week, it is a general practice in almost all the courts in Tamilnadu, but I dont know if some courts pass the orders of dissolving the marriage by a decree of divorce on the same day in other states. It is always better to wait for some time after the passing of decree/orders for re-marriage.
