i have 100% inherant property, transfered by my father on monther name before his death(father) , some property is converted into cash bank fixed deposit and some immovable property like residencial property, at the time of sale we given concent to father for sale and signed papers, but total amount is taken by father and then mother. now i want partition. pl guide me in this matter. my father is died and mother is alive. after the death of father all property and fixed deposits is with mother name, we are four child(one son and three sisters), one person(son) want to claim partition, is it possible ? if possible how many participants are there, four or with mother five. my mother stands that she is alive and participation is not possible. pl guide.

You will be eligible for i/5th share.File a partition suit.Consult a Lawyer.But please tell me how the property got transferred to your mother's name.Whether you have signed any deeds or whether you were minors at the time of your father's demise.Did your father write any will.Please clarify

Assuming that the entire properties namely movable and immovable has been transferred on your mother's name by a joint release deed by all the legal heirs to your deceased father except your mother, the entire properties will become your mother's exclusive properties, nobody has any right to seek partition or claim a share in the properties. The properties can be shared among all the legal heirs after the demise of your mother and she should not have executed any Will.
