This query is : Resolved
Married in September 2013
My wife filled complaint in women cell and dv case in oct 2013 against 6 members and after first hearing in women cell we applied for bail for my sister and jija ji, we were directed to district court mediation center, where settlement arrived and as per the settlement i have to pay certain amount in 3 installment
40% at the time of withdrawal of case.
30% first motion
30% second motion.
It was stated that on the date of dv she has to withdrew dv case and shall also withdrew both the present complaints in women cell.
We have paid the 40 % amount.
but she withdrew dv case and not coming to withdraw women cell complaint.
As per law the first motion has to be file in October.
Will you all expert will guide us what to do in order to ensure women cell complaint is withdrawn before first motion.
Is there any way by which we can quash the women cell complaint.
What legal action can i take against her.

1. It seems that she is keeping the CAW complaint pending till the first motion is filed as it is still not ONE YEAR from the date of marriage.
2. By way of abundant precaution, you should get bail confirmed in the Session Court (which shall grant you notice bail), that would make sure that there are not surprises for you.

Also, as she is not attending the CAW Cell proceedings, then the police itself would close the complaint as not pressed.
