This query is : Resolved
I have paid entire alimony to my wife during filing Mutual consent divorce petition.
After filing Mutual consent divorce petition in court I have got 6 months interval date for hearing and I appeared on this date and filed mutual affidavit (stating that no relation between both the parties at present and not to be in future) and got another 1.5 months date for councelling.
My question is
1. What will happen in this councelling and how long is time to take finalise the divorce.
2. what will happen if councelling failed or pass.

It is an attempt for the court to see whether the marriage can be saved or not.
If both of you don't want to continue with the marriage, the report of the counselling would be that the marriage can not be saved.

1. It is a regular process and an attempt to discourage divorce.
2. The case would be fixed for final hearing.

If both of you are not willing, the divorce by mutual consent will be awarded and it will not take much time.

Agree with the experts, if both of you do desire so, the MCD would be awarded. It is procedure to explore the possibility to save the marriage.

Yes, if both of you have once again stated that you indeed want to divorce each other by mutual consent on the next motion, the court will record the same and pronounce the decree dissolving your marriage by mutual consent. This is just another routine procedure followed by the court.
