Noc for allowing use to a related company

(Querist) 09 April 2014 This query is : Resolved
Hi,

I have leased my premises , situated at Noida, to a company. The company now intends to allow the use only a part of the premises to its associated company (its related company) and retain the remaining. They are now seeking our NOC for allowing such use by its related company. Please advise should we allow such use or not?

Thanks

Say sorry to the company. If later the other company starts using the whole of the premises and indulges in some illegal activities what will you do?

It appears the original lessee wish to create a sub-lease which is possible only if you permit in writing.
You rather make a new lease in respect of the portion that making a sub-lease which may give rise to future complications.

Agree with the advise of expert Deavjyoti Barman ji.

Yes the company is trying to sub let the property to another company which if done without your permission is illegal, but to avoide complication in the future, act now.
