Some part of my residential plot accupied by neighbour

Dear Sir/Madam,
Some part of my residential plot has been occupied by my neighbour as per our registered documents at the time of their house construction.They have not informed the same to us.
When we asked about the same, they are not giving proper explaination and they are strong with respect to money and power.
What i have to do now to get justice.
Pl provide your valuable sugetions.

If you are very sure that the neighbour has illegally occupied your area, You have to file suit for recovery of possession against them. Before that ascertain the extent of encroached area by measuring the properties.

Have a talk with your neighbour and engage a surveyor mutually accepted and take measurements. If he did not agree, you can do on your own and determine whether there is any encroachment and if so, what is the extent. Then engage the local known people to settle the issue by demanding compensation if the encroachment is small. Generally once construction is over, the other party will take stand that there is no encroachment. Once it is proved beyond doubt, he will come for compromise and make good of the amount. If the encroachment is on considerable extent, you serve notice on him for restructure his building within his own plot. He does not heed, file a suit.
Generally no police will help you in these matters.

I agree with the experts opinion, particularly the suggestions made by expert Mr. M.P. Jagga Rao. The court is the place where you will get relief on such issues and not the police.
