Transfer of gift deed

(Querist) 25 June 2014 This query is : Resolved 
Hello Experts,

My mother gifted me her self property with opinion of all my brother and sisters. After 3 years, 2 of my brothers have lodged a suit in court claiming to be family property. A week before i received the court notice, i had gifted the same property to my wife, with my mother's and sisters' consent. Though my brothers are not yet aware of transfer to my wife, will the gifted property from my mother to myself have a stand in court verdict?

Gift is valid and the suit filed by your brothers shall be dismissed, under the given circumstances.

yes , if it is her self acquired property then the gift is valid and your brother can not do anything.

If the questioned property has been gifted by your mother through registered deed then it is perfectly valid gift and the suit filed by your brothers will not stand.

If your mother had valid and marketable title to the property, the execution of registered gift deed by her to you is valid in law. If your brothers have filed a suit, let them prove their averment/stand.
