Fathers property procedures to get the share registered

(Querist) 15 October 2014 This query is : Resolved
Respected Sir/Madam,
My grand Father died last year i.e my mother’s father he had his own property & last year when he was suffering in illness my mother’s three brothers made Gift deed as per there requirement & they registered from my grandfather end. Now my Grandfather is no more & they have left little land to my mother & for her younger Sister, but they are not giving any proper documents to make the left land to my mother’s name & my aunt’s name.
What is the procedure to make the land register in my mother’s name? My grandmother is alive & the three sons never listen to her words of making the land to her daughter’s name & she is very upset since she want to give the little share whatever is left to be given to her daughters as early as possible.
Please advise what are the steps & procedures to get the land registered.

what was nature of illness suffered by your grand father ? was he mentally fit ? do you have any medical reports to prove your grand father mental illness? if so move court to set aside gift deed made your grand father and also obtain an injunction restraining your uncles from dealing with said property .

once you obtain injunction your uncles will come to negotiating table

Thanks for the fast reply Sir,

My grand father was suffering from Cancer & they made the gift deed when it was in almost the end stage & they dint disclosed that he was suffering from cancer to my mother or my aunt. So what can be our next step can the gift deed be cancelled in any case?

It is a fit case where the validity of gift deed can be challenged.
Meet a local lawyer and go for it.

Consult local lawyer and show him the available documents to advise for challenging the gift deed.

You should get the details of left out property and file case of partition on behalf of your mother.

In my opinion, the execution of gift deed is legally valid because the donor was in sound state of health at the time of execution. Therefore, if there was any property left behind by the three brothers in favor of their sisters other than the one they have already acquired/inherited through gift deed, both the sisters should get them mutated on their names properly through local revenue authorities.

you will have to move court in this regard . court will direct maintenance of staus quo pending hearing and final disposal of suit . you will have to prove grand father was not mentally fit
