Settlement of pension and other benefits for a retired person

the Encashment of earned leave at the credit of a retiring official is not yet paid by the government on the pretext of an DE pending. all other benefits are received from the accountant general. is it a condition to withhold the EL encashment benefit due to the pending DE. are there any ruling from Supreme court not to withheld the benefits accruing after retirement of a person. the person has retired on 31.01.2013.
can you please clarify.

Depends upon the extent of loss, if any, accrued on account of the irregularity committed by you for which charge sheet was issued.

If no loss has been indicated in the charge sheet, withholding of the leave encashment was not justified.

Further, you have not stated whether your gratuity, in full or part, has been withheld or not on account of DE.

the concerned minister had demanded RS.50 lakhs as party fund for which i did not oblige as to where should i bring such a huge money? hence this problem. the higher ups also did not bulge for my grievances but simply follwed the minister.
all other benefits are duly paid by Accountant General in time i.e. within three months of superannuation. it is only the earned leave of 283 days have to be paid.that is all

Your statement, "the concerned minister had demanded RS.50 lakhs as party fund for which i did not oblige," is not easy to digest. Was your income (rather illegal income so high to the tune of crores that the minister demanded Rs.50 Lakhs? What was the reason for his demand of Rs. 50 Lakhs from you, as party fund?

The most important thing is, you are not talking about the nature of charge against you in which DE is pending.

Partial facts may not probably be able to fetch any solution for your problem unless you elucidate the background appropriately. If not ready to divulge my previous reply still holds good for your query.
