HI, FOR OBTAINING MARRIAGE CERTIFICATE WE NEED THE DETAILS AND SIGNATURE OF THE PRIEST WHO SOLEMNISIED THE MARRIAGE. NOW THAT MY PARENTS ARE MARRIED SINCE 27 YEARS AND THE PRIEST HAS DIED, WHAT DO I DO TO GET THE MARRIAGE CERTIFICATE? PL HELP

Now what is the necessity of the same.Your Parents should be having Ration Card,Pass Port Etc where it would be mentioned clearly.If you are particular you could get the same from Registrar Office Completing the formalities required by them by enclosing an Affidavit that they were married before 27 years and getting it registered now only.Contact your Concerned Registrar in Person and He would guide you.Presence of your Parents at Registrar Office at the time of Registration would be mandatory.

Under which Act? Neither in Hindu nor in Special Marriage signature of priest is required.

you need certificate of pandit who performed your marriage for registration of your marriage under HMA . details of pandit who performed the marriage are required to be filled in by the parties in application form for registration of your marriage . in absence of these details it would not be possible to register your marriage

Dear Author,Details of Pandit's marriage is irrelevant for registration purpose and Affidavit will be Sufficient.Contact the Registrar in Person.

In most of the states such certificate is not required. Not aware of all states. If it is required in your state consult the Registrar office whether an affidavit may solve the purpose as the priest has expired.

dear all experts, thankyou for all your responses. i want to give more information as desired by some of you that this is the case of maharashtra state and the form given to me is FORM D WITH A HEADING MEMORANDUM OF MARRIAGE (SEE SECTION 6 AND RULE 5). ON THIS FORM THE OFFICIALS HAVE TOLD ME THAT FILLING POINT NO. 7 ABOUT THE PRIEST VIZ. NAME, ADDRESS, RELIGION, AGE AND HIS SIGN IS COMPULSORY. ON MY STATING THE INABILITY TO PROVIDE THESE DETAILS, THEY DONT SUGGEST ME ANY ALTERNATIVE EXCEPT FOR ENQUIRING AFTER A WEEK. I WISH TO FURTHER INFORM THAT I HAVE BEEN VISITING THEM CONTINUOUSLY SINCE PAST MANY WEEKS. WHAT DO I DO?

If the marriage is performed as per hindu rituals, you can submit the form D you can fill-up relevant columns with factual and available information and submit directly to the Sub-Registrar and obtain the acknowledgement either from him or from his office. He cannot reject the application on the pretext that it was not signed by a dead person. He will definitely suggest the alternative like giving a sworn affidavit.

thankyou jaggarao sir for your reply, i asked them for an alternative just the way you have suggested, but they are delaying me for quite a some time now. so i have sought for expert help by choosing this medium to suggest me the alternative procedure which expert people are sure about and well aware of since this is the platform of professionals

Madam,Basing on your Replies it is felt that Registrar is not a Person with helping mind.I would advise you to write a Letter in detail along with copy of affidavit stating the facts, enclosed with copy of the proofs like Ration Card,Pass Port or any other thing which carries your both Parents name and ask him for a Reply for the same for How to Proceed for Registration Under Right To Information Act Affixing necessary court fee Stamps and send it by Registered Post.Your Problem Would be solved in 30 Days.No Need For any Advocate for this which would cost you. .

The particulars and signature of the priest conducted the marriage to be obtained in the application for obtaining marriage certificate in Tamilnadu also is mandatory, without which the registrar will not accept the application. However, they do not strictly see that if the priest himself has signed or somebody did. Now since your matter is in the knowledge of the authorities, you may fill up the particulars of the priest conducted the marriage and in he signature column, you may leave it blank with an endorsement died'. This may be accepted or not, you may enquire from the registrar office.
