Maternal uncles depriveing us from ancestral property

My maternal uncles are trying to deprive us from ancestral property. they saying us very confidently that my mother has not entitle on the property. Because my mother is a married & She carrying different Family Surname. The property was registered in the of my Grandfather . Registered was done by Govt. Because that land was govt. Rehabilitation land. My Grandfather died on the year 1971. My Grandmother died. On the year 1994.

My maternal uncles are saying that Grandmother had given them . How can it possible? Has Grandmother any right to give them while the property was registered in the name of Grandfather ? They might be make some fordge documents like gift Deed & trying to contraction on that land .

Now my quary is How we move ? Can we appeal to the court for interim injunction ?
.Or

Before appeal to the court cam we lodge FIR against them?

It is possible to take anticipatory bail ?

take stay order from civil court against ur maternal uncles so that they cannot sell said property.

As per above stories my maternal uncles are not trying to sell that property. They are trying construction on that land also they try to demolish old existing building which still has on the land .

You can obtain the record from O/o authority under whose jurisdiction property falls.


This should have all docs including some forged documents as suspected by you.

The share of legal heirs shall be as per personal law that applies in your case.

You may obtain mutation records with all link docs (record) from O/o authority under whose jurisdiction property falls.


Once you have these you can ascertain what or if any fraudulent act was committed.
