Right to information act 2005

(Querist) 10 June 2017 This query is : Resolved 
When ever information is requested a statutory body replies "Files are not available hence information cannot be provided" Same are the replies on any documents or orders. Can they produce these in court saying they found it later. The appeal is placed before the Kerala State Information Commission as well but that is the stand of the organization(Cochin Devaswom Board). Can someone advise me what should be done. Will the documents denied/refused under RTI ACT hold valid in Court later.

Before moving to Court you are required to file second appeal.

The CIC has held that the stand of "missing/untraceable file" is an unconvincing reply. Bring this to the notice of the State Commission.

You can appeal with the first appellate authority and same reply you can file before State Commission for inspection of file/document as sought by you in the RTI application within the prescribed time limits.
