Recreational Club

(Querist) 29 September 2010 This query is : Resolved
Hi,

I am planning to open a recreational club in West Bengal.
The club would have various facilities like a health spa, gym, pool table etc.
I also want to have tables for playing cards at the club.
The club would be only for members.
Do I need to obtian a license for playing cards table at my club? Are there some legal formalities for the same?
Please advice. I would really appreciate your help.

Thanks

No license is issued in India for gambling in playing cards. You have to get the license under the camouflage of a recreational club and run the show successfully for gambling also. When you are caught by the police by raiding, do not forget to rely on the judgment of the Supreme Court of India where it has been laid down that Rummy is not a game of chance but a game of wits and playing rummy is not gambling.Even for preventing raids from being conducted, certain clubs in Chennai have taken judicial orders from the courts that such raids must be conducted in the presence of advocate commissioners only appointed by the courts for this purpose.
Hence you are safe and do not worry. There are always the courts in this Democratic India to protect every kind of activity however illegal they may be.

Sir,

Thanks for your reply.

Yes, I want to have rummy tables for my club.

Sir, Is it possible to get a copy of this verdict of the supreme court that can be shown in case of any raids?

Also, do I need to mention anything special in the memorandum/articles of association of my copmany or the trade license?

Could you please assist me with this?
I am more then happy to provide you with legal fess if any.

Thanks and Regards,
