mutual divorce

Guest (Querist) 17 March 2011 This query is : Resolved
what is the easiest & earliest procedure to get divorce by mutual consent? how can the alimony be given permanently by lumpsum or monthly basis? will the wife have any share in the property which the person belong?
M.Sheik Mohammed Ali (Expert) 17 March 2011
if you ready to give monthly basis or lumpsum amount you inform to court, and if you give permanent alimony is best way, because she will not come for further touch with you. that day is finished relationship both of you, and mutual consent will get within 6 month.

Take the undertaking from her that she will not claim and also in your petition state the same thing that permanent alimony is being given for the rest of life and it includes all that dowry/ dowry articles, household furnitures etc. and maintenance and also if there is minor child then do inform the Court about the same and also there should be a competent person duly authorised by the Court who can act as guardian for the minor, so that in future the minor cannot also claim anything.
In this way the demands can be fulfilled.

even waiver application can be filed in some cases to shorten litigation by cutting the 6 months
