registration of lease document?

Is it necessary to register a building lease agreement for 5 years? What will be the problems of not registering? I am the lessor and the lessee is a govt autonomous education society.

all agreement is not compulsory register, if we will register any agreement valid for us,
incase the tenant is not evict from the premises, then file a suit, the court first ask why not register the agreement the make fine, after that the case will continue.

If this agreement is in Bengal then the all the lease agreement reserving monthly rent is compulsorily registrable.
A compulsorily registrable agreement is not admissible in evidence unless the court impounds it and levies the deficit stamp duty including penalty.
However the relationship between the parties as lessor and the lessee does not vitiate.

Dear Anonymous,
Any lease which is for a period of one year and above is compulsorily registrable in terms of Section 17 of the Indian Registration Act, 1908.
If the lease is not registered, then the unregistered lease deed will not be admitted as an evidence before a Court of law. It will become very difficult for you to prove your case on the basis of the unregistered lease deed.

For All purposes it is required to be Registered- the lessee is Govt Antonymous Educational Society - There will be Notice from SRO for not Registering and not paying the Stamp duty - to prove Terms of the lease the lease deed is required to Registered !

Under the Mah rent control act there is fine and conviction for not registering the lease agreement.
