Dear experts, I am working as Asst. Prosecution Officer. In Home (Police) department, Bihar . I have regularly receiving phone calls from Bank, New Delhi that you had taken a credit card and due to non payment, the bank is asking you as you are responsible because one person had taken credit card in 2005 and given this phone number in his contact (unfortunately my phone number has been given). The bank has also giving threatening me to take some legal action as there will be some connection with that person, so he has given your phone number. I replied, I am fully unaware of that persons and had not taken any credit card. In this situation, dear experts, suggest me, what legal action can be taken

FIRST UPON GIVE A COMPLAINT REGARDING THE NUISANCE CALL TO THE CONCERNED POLICE STATION AS AGAINST THE BANK AND ITS OFFICIALS.
DESPITE THE COMPLAINT PROBLEM PERSISTS FILE A WRIT AGAINST BANK BEFORE CONCERNED HIGHCOURT FOR REMEDY.

do not worry because at the time of issue of the credit card a bank always ask for proof of residence & identity of the person; moreover the customer must be introduced by another customer of the bank. so, if you have not receive a credit card from the bank, they cannot claim payment only on the basis of the telephone number.

You are a lawyer, who what best the bank do against you, when you have not borrowed or guarantor.

dont worry about such calls, various financial institutions and telecom companies have hired Recovery Agents in Delhi for such purposes.
you call must have introduced himself from Tis Hazari Court in Delhi.
u need not to worry about this....these are frivolous calls....recently I received such a call due to some telecom dispute....but I gave him full Punjabi Style dose on phone itself....
but if u feel threatened then you may report the matter to the police for action.

You need not give any explaination in reply to the phone call, except asking them to send a written notice to you with details. They would never send you any written notice, if you were neither the borrower, nor a guarantor to the loan of the defaulting person.
In fact such type of tactics are not applied by any bank, but their collecting agents only just to get the money extracted by hook or by crook to get their commission.
