I have certain query plz help me.
1) A well known tradename is Liberty, plz tell me can i start our business with name of Liberty Electrical Store. or
2) A tradename is Unique Departmental Store, Can I start Our Business with name of Unique Electrical Store

A well known trade name has been defined in section 2(1)(zg) of The Trade Marks Act 1999. In brief a well known trade name means a trade name which has become so the substantial segment of the public which uses such goods or receives such services that the use of the mark in relation to the other goods or services would be likely to be taken as indicating a connection with the prior one. Even if the nature of the goods or services differs the opposite party may oppose on the ground that the exclusivity attached with their goods or services is harmed. Better you select other names. (Even section 21 of the Companies Act has also amended itself to share view of the trade marks Act.) Thanks....
