Respected experts,
In family court maintenance case (125) recover suit my fiends against her wife .my fiends not go court his notice date.He send cheques his lawyer.His lawyer go to court She can’t accept this cheques in court.In this day lord not come in court. 2 date give court in dec.my query is can court issue arrest warrant if lady need warrant.(2) He want regular pay his maintenance where deposite amount by cheques becuase lady can’t want to give a.c details. Final judgment not come.

if the maintinance payment is ready and husband want to pay the amount through cheque and wife is not accepting the cheque then no need to worry about this deposit the cheque in the court, but if the lady filed an application before the court and mislead the court that husband is not willing to pay or ready to pay the amount and prayer for Warrant and husband or his advocate is not appear in the court then the court may issue the warrant, but if the husband or his advocate appear in the court and inform that he is ready to pay the amount then the court can not issue warrant for arrest or waarant for property attachment.

My friends lawyer appear the court.But Jajsahad not coming in this day.Lady also suit recovering 8 months.This recover my friends want pay 3 cheque is months but she can't accept.My friend lawyer deposited cheques in court.1 cheque today date. 2 cheque is after 10 days.3 cheque is after 10 days.Also court given next date in december 2011.We want pay regular by cheques.His lawyer deposited cheques in court.

if cheque has been deposited in court you have nothing to fear . if wife is not accepting the cheques it is her problem .

1. Distress measures would be used only if the amount is not deposited.
2. Even before arrest, an opportunity would be given to give the payment.
The things would be different, if previous cheques have bounced.

Previous cheques not bounced.my freinds lawyer not deposited cheques in court. my freind say today we send partly amount in cash u deposited in the court tomorrow.And remain amount my freinds pay next date december .His lawyer say may lady lawyer setting other jaj issue the arrest warrant.I want know about after court give next date court issue warrant or not.

I think you have failed the understand the replies given by all.
It has been made quite clear that you or your friend whatever submits the cheques then there is no chance of issuance of warrant. Moreover the same is issued in the Execution case and not in the maintenance case.

Now a days banking at all places are on line,then your friend should request the court that your wife furnishes a detail of her bank a/c maintained and seek permission of court to deposit the money from his place in her a/c and keeps all the receipts safe as proof for future.
A second way may be to give a standing direction to his banker to transfer money every month from his a/c to her a/c.
