Gpoa

(Querist) 08 June 2012 This query is : Resolved 
A has given B GPOA FOR 4500 sqft Vaccant land.B has given GPOA to C. after two years C has given GPOA CUM SALE AGREEMENT to D. Now my friend is going to purchase the property of A.where as if D executes the sale deed is valid or not? all the GPOA are registered. Issue is based on chennai area. pl advice?

it is valid but you are at big stake of risk.

You should have signs of A only.

In deed the power of attorney are not POA, they are transfer for consideration form a to B and then to C and to D. That is why the A is not ready to honor his POA. Such transfers of property in shape of POA are not valid. The Supreme Court is very strict to prevent such type of transfers.

The property needs to be freehold before the same can be sold now.
