(Querist) 23 May 2013 This query is : Resolved
During marriage a wife is given gold both from her side and also from a groom's side. What happens to these gold after divorce. Wife has all the gold with her. How can a guy claim back the gold which he gave? Incase if the girl denies that gold is not with her. How can a guy proof infront of the court that she has all the gold and put a false case. How can a guy get justice?

All gold given to her during marriage is her absolute property being Stri-dhan.

Gold is with her or not, once gifted by her inlaws that becomes the property of the bride. However, if she has put a false case about the gold being with her husband or in-laws, none else other than her husband or in-laws can point out towards the proof of her taking with her.

but what will happen to the gold given by bride's father to the groom. Is that again Stri-dhan? The gold chain and engagement ring given to me is with her.

The ornaments given to groom do not come within the definition of gift rather the formula for the bride is otherwise. This is a controversy in law.

keeping such gold with you is criminal offence.

It is her gold now and you have to forget the same.

Dear Abhisek
it is a matter of Trial before the court and not a matter of merely consultation, it is better for you to consult with a lawyer in your area with all you documents.
ajay sethi (Expert) 25 May 2013
you have to cross examine her on her claims .
Sudhir Kumar, Advocate (Expert) 25 May 2013
you have to defend by proving that gold has been given
