Hi my name is anirudh and i am from west bengal. i got married in the year 2010,Nov.
I came to know that my wife is already married with a guy before our marriage and she hidden this matter from me. And after knowing this matter from reliable source i asked her. She left my house and filed a false case of attempting murder to me and said for monthly maintenance.
I just know that she had married a guy with a register marriage in the year 2007-2008, I have tried a lot to find a document proof of her previous marriage but i failed. I want to file a divorce but how can i prove that she had a previous register marriage with another guy. AND the court never believe me without any prove.
I am filling divorce because she is not living with me and she only wants maintenance from me.
NOW We had a 6 months baby too.
Can i get divorce??? I some time fear that my wife with her first husband may kill me as i came to know from source that she is now contact with him.

In stead of filing divorce suit , you better file suit for annulment of marriage.
If her earlier marriage is still legally existing, your own marriage is a non est in the eye of law and hence you can not seek divorce.

Even if you post the same query n number of times you will not get a advice of your choice.
However, the can adapt the following course of action:
1) Apply to the Marriage REgistrar of the girl's jurisdiction (concerned sub-registrar office under which jurisdiction the girl lives) by affixing stamp duty (Rs.2 in AP) seeking information whether any marriage is performed to the girl and if so the Registration Number Date and name of the spouse, his address. Give full name of the girl and her father's name and the year in which you are doubting that the marriage was performed.
2) It is obligatory for the Marriage Registrar to give the information. It will not take much time to verify and give the information.
3) After getting the information apply for a certified copy of the Registration. You may mention in the application that it is required as the girl suppressed this information and married you. They will give you the certificate.
4) If you found no information, you again apply with the Marriage Regitrar of the boy's jurisdiction as above.
5) In both the places if the information is not available, you can come to a conclusion that the marriage was not registered.
6) Once you get the information, you can file case for nullifying your marriage as your marriage is void abinitio. You need not pay any maintenance to the girl. However, since you have a baby, the baby is entitled for maintenance.
