Gratuity eligibility

Hello,
I have joined an organization in gujarat on 1st July, 2008 and was relieved on 10th June, 2013. In between due to fracture i was on leave for three months. So i want to know whether i am eligible for gratuity or not. Kindly advise.

they are denying me ans saying that if u r employedfor five years then only you are eligible. how to approach for it. kindly advise

Issue notice in Form I and file a case with the controlling Authority claiming gratuity.You can engage a lawyer to proceed with.

4 years and 220 days are sufficient to earn gratuity which you have already completed in service so are duly entitled.
