Tenant's right to parking

(Querist) 07 October 2013 This query is : Resolved
I am a Tenant on a Housing Society in Mumbai. I recently bought a vehicle but on day 1 itself I was not allowed parking in the building. The secretary stated that the committee has passed a resolution to allow parking only to members of the society. So I called the owner (member of society) informing of the same. He said that the society had not sought his approval on the resolution and that the parking should be made available at the charges applicable, which I am fine with.

Kindly suggest a recourse.

a tenant would be a nominal member of society . a nominal member has no rights for car parking . how many parking slots are available in society? is there a shortage of slots? if any slot has been alloted to owner who has given his flat on leave and license

Ajay;

Thank you for your response.

The Society has space to park total 6 vehicles one behind the other( 3 in front of building and rear respectively) and slots are all open slots that can be used on payment of parking charges.

The owner (member) informs me that he has been assured a parking slot for his use.

you have not mentioned how many members are there in society . if number of members are more than parking slots society would give preference to members rather than tenants for parking the cars
Nirav Jagad (Querist) 07 October 2013
There are 12 members in the society.
Rajendra K Goyal (Expert) 07 October 2013
The parking slots are less hence the members have decided so.
Raj Kumar Makkad (Expert) 07 October 2013
The decision of majority of members of the society shall prevail in the given case. The modality of allocation is to be decided by society in majority vote.
