1- From where can a succession certificate be obtained?
2- What documents are required to obtain a succession certficate, if the surviving legal heirs are second wife, son and daughter from first marriage?
3- How much time does it take to obtain a succession certificate?
4- What is the fee involved?

1)From CIVIL COURT.
But it is issued for collection of debts and securities and cash at banks.
For immovable properties it is not required.
2)Death certificate and extracts of Family Register from village secretary or from local town area or municipal board(as the case may be) and particulars of debts and securities and cash at banks with their value.
3)Three to six months.
4)Fee payable as court fees would depend on amount involved and on the state court
fees Act,they differ state to state.

in Mumbai succession certificate is issued by High court . takes around 6 months . maximum court fees Rs 75,000

As i understand by the reply to my query above, succession certificate is not required in case of a immovable property. Am I right? If that's true, will the title of an inherited flat be considered clear without a succession certificate?

did the deceased leave any will . if he died intestate make an application to society for transfer of flat in name of legal heirs . furnish indemnity bond as required by society . comply with the legal formalities sought by society .
