Not giving occupation certificate

(Querist) 19 November 2013 This query is : Resolved
Hi,

I have purchased a flat in Bangalore and I have registered. Now Builder is demanding for 25K for issuing occupancy certificate. They are collecting money from everyone and there are 100 flats. My question here is, who should bear the cost for this certificate? Builder or flat owners? Does it cost 25 lacs for this certificate?

Thanks and Regards,

Dear Vijetha
Occupation certificate issued by building department so you can individually met or visit the said department and get.

Occupation certificate charge are not such as you describe.

Hi Abdul,

I think OC will be given for whole apartment. I want to know whether owners of flats need to pay or builder should bear the OC cost.

Thanks and Regards,

You can consult the building department and can verify the charges for the same.

Collect as many owners of the premises together, approach the concerned authorities and give a representation in writing seeking the proper procedure to obtain the occupation certificate and necessary fee for the purpose, ignore the builder if he is appearing to charge an exorbitant amount.

Occupancy certificate is to be obtained as a whole for which the builder will apply to the concerned authorities. The charges will not that exorbitant. The builder might be attempting to load profit in the "other expenses" to be incurred in obtaining OC! All of you have a talk the builder and impress upon him to collect reasonable charges. Even if you approach the concerned authorities, you will be possessing the required documents to be submitted for this purpose.

it is builder responsibility to obatin OC . costs have to be borne by builder . if he fails to do so move consumer forum against builder
