Taking pet dog for walk

(Querist) 30 December 2013 This query is : Resolved
Hi

I am from chennai and living in my current residence from 1982.
I am a member of Lawyers club for ~3 years

I am having a pet dog, I am taking it for a walk daily for the past 2 years in the road backside to my house which is just 30 secs away from my house. 2 days before few men living in that road called me and said I should take my dog for a walk only in the main road and I dont have any right to come to the road behind my house as these houses (all separate individual houses and not flats)have an association and will not allow any outsider to come there and that too take a dog for a walk as it is a nuisance. I was really surprised and said that the road is a goverment road which is under the local municipal control and it is not their private area or apartment complex with a compound, and said that the road leads and connects various localities behind and is being used by people for years, but they shouted at me and said that they will handover me to the police station (by saying that I am a thief)if I come there again, I finally said to them that they cannot stop me by such threats and said I will use the road do whatever you can and came home

The next day I went but didnt see those men.

I want to know, whether, what these men did is right as per law, can they obstruct any common people from using a government road in the name of associations and can they threaten me that they will handover me to the police station for using the road by framing me that i am a thief

Is what I spoke is right, or what I should have done and what should I do in future if these men again stop me from using the road

Regards

Ravindran

1. Being a thorough fare no one can stop you.
2. Framing you or any one else do not required any authentication/rule, which is subject to harassment, torture and unnecessary troubling a person, no one can stop/predict.
3. You are right.

Yes, Dr Vashita has rightly advised you.
You have every right to take your dog for walk on that public pathway.
krishna mohan (Expert) 30 December 2013
You can go with your pet dog in public place as long as it is not causing any disturbance to any body including your neiggbour in the community. You may either consult Blue cross if the problem still persist or the local police.

When you demand rights than you also have duties.

You can use any road but not with your dog.

Dog bites if not cured properly can be even fatal so who will be responsible.

More ever you have to take licence and have to keep records of regular vaccination otherwise it is criminal offense against public.

Some people does such act to show their identity and existence or to satisfy their ego. Nothing can be done but to avoid such people.

So long the pet on a walk with the master does not creates nuisance or indulge in the cruel act on the passers-by, it cannot be objected by any one,but if the objection by the road side squatters are with some inner intention, better avoid confrontation lest your peaceful living in the locality will get disturbed.

We do not have any legislation about it,probably no law even in U.K.

Hence your right in this regard is subject to LAW OF TORT.
DEFENSE ADVOCATE.-firmaction@g (Expert) 30 December 2013
First of all you have to consult medical books for effects of dog bites for which there is no known cure except vaccines.

And RABBIES that is dog bite effect can relapse even after vaccine and known cases of after no of years of dog bite. YOU CAN KNOW IT FROM FARMERS AND ADIVASIS.

And keeping of pet dogs is controlled by local bodies .

IPC HAS ENOUGH PROVISIONS TO CARE FOR SUCH MISCHIEF .
