Chargesheet

Guest (Querist) 03 February 2014 This query is : Resolved
If 498A FIR done through 156(3) in court, can chargesheet have new allegations or chargesheet will be limited to the mentioned incidents of FIR with elaboration.

Is there any relevant judgment on this?
Devajyoti Barman (Expert) 03 February 2014
On charge sheet only brief history of case is mentioned apart form list of witnesses and articles seized.
The description of facts has nothing to do with the merit of your case.
Judgements are not supplied here.
Advocate. Arunagiri (Expert) 03 February 2014
u/s 156 (3) cr.p.c. the court would have directed the police to investigate.

The charge sheet is the summary of investigation, so it will include all the findings of the investigation by the police.

Well advised, agree to it.
