Motor claim repudation

Dear Alls
The Reliance General Insurance company has refused for motor claim for my accidental car, the reason is mentioned that you have taken NCB, so your claim has been rejected. My all documents is completed in all respect. The policy was issued on 30-03-2013 and the claim was filed on 15-11-2013.
Should i go throw consumer court. Please advice me.

Dear Mr. Sushil,
Normally, NCB (No claim Bonus) is allowed by the company as a discount in the premium amount, based on the past performance i.e. you did not make any insurance claim in the past. That has nothing to do with accident claim that may occur thereafter. As for instance, if you have availed the NCB for past performance, in case any accident takes place thereafter and you make a claim, all that would mean is that you would not be entitled to NCB when you try to renew your insurance again. But that cannot be a ground for repudiating your insurance claim.
But, it is not clear about the terms and conditions under which NCB was availed by you.
Without knowing this, it will not be possible to suggest any remedy that may be available to you.

Dear Sir,
let me explain all matter:-
When i insured my car,i don't know that what i have commit to insurer's agent. But if i have taken NCB benefit during insurance , so its insurer duty to check , whether claim has taken or not in previous insurance.
I have submitted my all concerning documents to surveyor on 14-11-2013, he told me that your claim will be done with in two week. after that surveyor called me for bribe rs.10000/- & i refused him for any kind of bribe. I also complaint to reliance general motor call center about that. Then the surveyor submitted report to claim department any my claim has rejected.
( In view of above one event i have remember: when i was doing job in Educational trust . i made a insurance from Bajaj Allianze Insurance , after few days he rejected my insurance and refund amount saying that you have taken claim in previous insurance.So reliance should reject my insurance when it was made)

File a complaint with the Consumer Forum. Consult a local lawyer.

Taking NCB does't mean that you can't claim. You can approach consumer forum. It is better to appoint advocate.

IRDA will not adjudicate the dispute.
Better go to consumer forum first.
