Dear Experts,

An educational and charitable trust is registered under Bombay Public Trust Act 1950 in Karnataka. Now the Act has been abolished. Therefore, under which ACT does the NGO fall and is accountable. Appreciate you valuable Advise.

Dear Experts

Thank you very much for your feedback.
In fact, I did not make it clear in my query the practical problem we are facing. We are a Charitable organisation working among people with disabilities, leprosy and HIV/AID in Northern Karnataka. We are registered under Bombay Pubic Trust Act and used to submit our returns to Charity Commissioner Belgaum and various Govt. Offices within the stipulated time. But now, the BPT Act has been abolished and we do no have any clarity as to whom are we accountable and under which Act we are regulated by. When inquired with the local lawyers, We were informed that we would fall under THE HINDU RELIGIOUS INSTITUTIONS AND CHARITABLE ENDOWMENTS ACT, 1997. Appreciate your thoughts on matter.

It is true that

THE HINDU RELIGIOUS INSTITUTIONS AND
CHARITABLE ENDOWMENTS ACT, 1997 has been promulgated to bring about a uniform law for regulating various charitable and religious institutions as can be seen below from the statement of objects and reasons of the said act .

"STATEMENT OF OBJECTS AND REASONS
There has been before the State Government, a long standing public demand to
bring about a uniform law to provide for the regulation of all Charitable Endowments and Hindu Religious Institutions in the State. Which are now regulated under different
enactments, having local application in different parts of the State, namely:-
(1) The Karnataka Religious and Charitable Institutions Act, 1927;
(2) The Madras Hindu Religious and Charitable Endowment Act, 1951;
(3) The Bombay Public Trust Act, 1950;
(4) The Hyderabad Endowment Act, Regulations, 2349F; and
(5) The Coorg Temple Funds Management Act, 1956.
It is therefore proposed to enact a new law to replace the several local Acts to
bring about uniformity in the matter of regulating, by law, the various Charitable
Endowment and Hindu Religious Institutions, especially..."
so you may deal with the said act from now on.

Is the hindu religious act applicable to all public trusts and all religious and charitable institution or it is applicable only for hindu religious?

Is there any registration required for the existing trust which is registered under Bombay public trust.
Please guide.

Dear All

I had the privilege to find some judgement which says" A Government circular dated 19.3.2004 was issued stating that in the light of the repeal of the Bombay Public Trusts 1950 Act, the institutions such as educational institutions and non-hindu charitable institutions registered under the Bombay Public Trust Act 1950 not falling under the Karnataka Hindu Religious and Charitable Endowments Act 1997 will be governed by the Charitable and Religious Trusts Act 1920.

If the above circular dated 19.3.2004 is available please share.
