Court intervention to help husband

(Querist) 07 July 2014 This query is : Resolved
Wife is a paranoid case, with ultra-suspicious nature, makes baseless accusations against husband of having extramarital affairs, without any basis, abuses him and affects his normal life. She refuses to have any psychiatrist help, saying she is alright. Husband is very frustrated but doesn't want a divorce. Can the courts direct the wife to seek medical help, after looking into the case? Or is there any other way to provide relief to the husband, who is in a very difficult situation? PLEASE HELP GENUINELY!

visit a family counsellor . talk to her parents . let them convince their daughter to seek medical help
ashu kumar (Querist) 07 July 2014
1. She is not prepared to goto any counsellor, saying that the husband is at fault.
2. Her parents have been contacted, but are unwilling to help.
3. The husband has high hopes in the Indian judicial system, because he is facing real trouble. Surely some way has to be found.
Can anyone help?

is any court case pending???
ashu kumar (Querist) 07 July 2014
No! There is no court case as yet. Husband now wants to approach the courts to tell them the entire sequence of events , and then somehow get an order to make the wife seek the help of some psychiatrist. Actually it was a sort of happy family, but due to some misunderstandings, coupled with the traces of paranoid nature(SHE HAS ALWAYS BEEN A SUSPICIOUS KIND), things have taken a bad turn. That's why husband thinks that a counsellor can solve the matter, PROVIDED SHE IS PREPARED TO GOTO A COUNSELLOR/PSYCHIATRIST.

Court can not force to seek medical assistance. Either you have to bring her to counselors/doctors or face the consequences.

Is there justice in this country? Either courts can give divorce, or do nothing? And poor husbands are left to languish. Is there a lacuna ? Surely , there must be a way out.
ashu kumar (Querist) 08 July 2014
Surely, there must be a way, so that , at least the husband can present his case in front of the court. Is it possible? Whether courts force the wife to seek medical assistance or not, at least they can try to make her understand. Right now, there is nobody who can do this.

file for divorce on grounds of mental cruelty . case would be referred for counselling . if your wife does not appear you get divorce . if wife appears suggest visit to psychiatrist to settle the matter .

Thanks Mr Ajay Sethi. I want to know one thing, I don't like this word" divorce", can I still ask for counselling or mediation? I have suffered mental harassment, such as abuses, baseless accusations, humiliations etc. So can that not form the basis to ask for counselling and visit to psychiatrist etc? I don't want to lose my wife, and still want an honourable, peaceful life. Is there a way?
ashu kumar (Querist) 11 July 2014
Please anyone, answer me. On grounds of mental cruelty, can I not ask for the court to listen to my side of the story, and give a plea to check and decide about the mental condition of my wife? The courts may decide to go for mental checkup?

Answer of Shri Ajay Sethi serves both your purposes. Act accordingly.
Court can order , if councillor recommend and you apply for psy..
