Dear experts
Can I file divorce case on basis of desertion of two year while proceedings on rcr filed by wife is carrying on.

Dear Mr. Vajinderpalsingh,
1. You cannot have two simultaneous case instituted under the H.M.Act. Either you withdraw the R.C.R. case and then file divorce petition on grounds of desertion over two years which is a valid ground to seek divorce.
2. How long has been the R.C.R. case going on ? Has your wife appeared for such proceedings ? What is the status of this R.C.R. case ?
3. If you manage to get the R.C.R. decree then after having the decree executed on her and if she does not join you within one year then you can file petition for divorce u/s 13 (1-A)(ii) of the H.M.A.

Dear Experst,
Its my wife who filed RCR to me and i am replying to her RCR. She filed RCR in may 2014. My wife only appeared in mediation two or three times. now her father is appearing. I havent file any case on her.
