Succession certificate

Dear Sir,

I am residing in Delhi since by borne .
Kindly advise to get the Money of My father from Bank Located at Noida where he was working , which court we should approach for getting the Succession Certificate Noida Civil Court or Delhi Civil Court.

Please advise with your expert view

Dear Mr. Uday Kumar,

1. Since the Bank is in NOIDA then it is preferable that you file civil suit for such purpose at NOIDA civil Court.

If there exist nomination then bank can discharge its responsibility by making the payment to nominated person and nominee can distribute to legal heirs/successors.

If there is some reason or dispute succession certificate from court is option.

If the nomination existed in the account, Bank would honor the nomination.

If not exist, You can submit application, affidavit, indemnity as per procedure laid down by RBI on prescribed format, lodge the claim and receive the outstanding.
