O3 r1&2 of cpc. recognised agent

(Querist) 11 March 2015 This query is : Resolved 
I have filed an execution petition on behalf of my nice and the power is recognised by the court.After counter by J.D. I was prevented by the preceding officer to argue saying that i am not allowed by the prevailing rules. Kindly enlighten me is it correct and do's not's by a power agent or recognised agent by the prevailing rules.

1. Although R-1 of Order 3 C.P.C. does provide recognition and appearance of a recognized agent yet in the proviso of such rule it is provided that it is the discretion of the court to insist the party involved to remain present in person rather then his agent.
