Credit card frauds

(Querist) 09 December 2015 This query is : Resolved
Dear Sir

In the year 2007 there was a credit card fraud that took place in my credit card, the payment against the same was not paid,by i had filed a police case but the bank issued me a notice and started arbitration against me and finally in 2012 the bank withdrew the case.

Now my problem is that my name is still reflecting in cibil

hence kindly guide

You may serve a Notice, preferably through an advocate, asking the Bank to correct their mistake. A copy may be endorsed to CIBIL as well.

Write to the Banker to rectify the situation. Till time bank can give you a certificate / letter to clarify the situation.
Kumar Doab (Expert) 10 December 2015
The bank has kept the leverage with it i.e CIBIL.

It is arm twisting.

You may notice the bank (MD,Chairman) to accept its defaults and withdraw your name from CIBIL accepting its default and deficiency, and write to CIBIL with a copy to YOU and supply you the latest credit/CIBIL report, showing your name and also BANK's name.

Thereafter you may approach RBI/DCDRF/Civil court.
It is unlikely that a bank and banker may do it on its own.

Dear Sir

Credit card was of ABN Amro Which was taken over by royal bank of scotland who has now sold its NPA to a Private firm

hence would kindly suggest way out
T. Kalaiselvan, Advocate (Expert) 19 December 2015
Now whatever claim you have shall be routed to the private firm who bought the NPA from ABN Amro. You have to write to issue them the legal notice giving entire details and advise them to arrange for removing adverse details of yours from CIBIL in view of the facts narrated to them with documentary evidences provided to them. You may endorse a copy to CIBIl too and also can make an online complaint to CIBIL directly, who will certainly respond to your complaint.
Kumar Doab (Expert) 19 December 2015
The company on its own has withdrawn arbitration proceedings.

Probably the amount entered as debt is time barred too.

If the merits are on your side and MD of the bank (last bank) has also not responded then you can consider get the award from DCDRF or refer to governor/customer service dept RBI.
