a person can be released either on bail or on a personal bond under sec436 .i would like to know the difference between the two ie bail and personal bond..

bail is an order releasing an accused on the fulfillment of certain conditions mentioned in the order whereas the personal bond is just an undertaking on the part of the person executing it to follow the terms mentioned therein. Bond is not passed by court rather it is executed by an individual whereas bond is filled by an individual.

Bail means, an assurance of surety, that the accused will appear before court and follow the conditions of bail, in case of failuire on the part of accused, amount mentioned in the order shall be deposited by surety. Personal bond is a bond signed by accused himself that he would appear before the court and follow the condition of order of court.

REGARDING THE MATTER KINDLY NOTE THAT.
1.BAIL BOND - BAIL APPLICATION WHEN ALLOWED ACCUSED AND HIS SURETY HAVE TO SIGN BAIL BONDS WHERE AMOUNT OF BOND IS MENTIONED.IN CASE ACCUSED REMAINS ABSENT ON NEXT DATE BAIL BOND AMOUNT MAY BE FORFEITED BY THE COURT AND SURETY WILL BE SENT A NOTICE TO DEPOSIT THE SAID AMOUNT IN COURT.
2.PERSONAL BOND MEANS COURT RELEASES ACCUSED ON FURNISHING PERSONAL BOND OF CERTAIN AMOUNT.IN CASE ACCUSED REMAINS ABSENT IN COURT ON NEXT DATE THEN COURT MAY CANCALL THE SAID PERSONAL BOND AND ORDER ARREST OF THE ACCUSED.
