Bank

(Querist) 12 May 2017 This query is : Resolved 
Sir,My mother was taken a loan against the property ( property not Mortgage by Bank ) same was cleared with interest.
Problems
1. Not Given no dues certificate
2. Not given last payment receipts
3. Not give my original Documents
When I was cleared all Payments.in feb.2004
In April 2004 Bank liences was suspended by RBI.
Liquidator is looking the matter now
No dues on my mother Name but
Original Documents r pledge to another person ( who I don't at all )
Number of went & requested them
But they r saying we can't help u
More than 10 years r over
Please advise me what should I do now

Bank is under liability to return the deposited documents. Since liquidator is in management of bank send him a notice to issue no dues and return the documents. You may file a complaint before consumer forum if documents are not returned

It seems Bank officials have acted fraudulently, kept the documents by getting signed illegally by your mother for mortgaging the property in some other person account.

If so, discuss with local lawyer and lodge FIR against them.

File court case for documents after sending legal notice.

You must be having loan a/c statement before last payment and acknowledgment of last payment.

You may engage a senior counsel of unshakable repute and integrity at your location specializing in such/banking matters with all docs on record that you have, ASAP.

Sketchy information and vague query, which may be hypothetical.

If the statement is true, file a police complaint for criminal breach of trust besides a suit for declaration, permanent and mandatory injunction through a local prudent lawyer.

Well advised by experts. If your version is true complain to Banking Obmudsman in writing for right action. You can provide all details of loan settlement. Parallelly you can issue legal notice to CMD of the Bank with all details to return all documents with NOC by a date failing which initiation of case against the Bank.

Instead of wasting any more time lodge police complaint and also entrust the matter to a very able counsel as already suggested.
