Sir My Father a UP govt employee retired in december 2008, as per the payment of gratuity act what is the amount of gratuity he is eligible to receive? Another thing is whether an employee who is working continuously for more than 10 years but is not a permanent employee, is he eligible for gratuity?

more then 5 years working as a employee he become claim to gratuity, once again check it the up govt deducted any ESI,PF, amount in his salary, if yes, then he will having rights.

Thnx sir But I want to clarify if he retired in December 2008 whether he will be eligible for gratuity of Rs. 10 lakhs as per the sixth pay commission?

First of all, gratuity claim is limited to half month's emoluments (salary) for each completed year of service. Rs. 10 Lakhs is the maximum limit beyong which high salaried persons cannot get gratuity.
2ndly, the recommendations of 6th Pay Commission were meant for the Central Government servants. However that depends solely upon the date from which the recommendations of the CPC were accepted by the concerned state.
