P& sc case publication

(Querist) 04 April 2012 This query is : Resolved
I had filed a P & Sc Case & the court has ordered for publication in the matter & accordingly it’s been published, except that I forgot to get the order copy and then publish it. As I had my office copy of the publication & had seen the order for such publication (without any changes compared to office copy), I had given for publication, now the Hon’ble Judge is asking reasons for not obtaining the order copy & then publish it. In the circumstances, I want to know whether the court has the suo mutto power to ratify the above procedural mistake or is there any case laws, which can be produced before the court in such a situation.
Thanks,
with regards,

Dear Sir,
Thank you for the reply. but how to convince the court that it has got such powers.

Section 151 of CPC is sufficient to be quoted for that purpose.

The news papers normally publish such notices only if they are authenticated by the authorised court officer. I dont know how in your case it so happened. Getting the authenticated copy for publication being an administrative act and departure therefrom is not fatal especially when there is no correction. Convince the court with 151 application and it is the only way.
