Partition & arrears of rent

Dear Sir,
I and my brother purchased one property and further let it out to various tenants. All the rent was received by my brother, he paid me only Rs.4000/- per month as my one half share but actual rent of the building is about 65000/-. when i came to know about fact i asked him to give me half share but he flatly refused. now i want to claim rent for the last 3years from my brother and i want further rent @ Rs.37500/- per month and further want to partition of entire building. pl tell me what can i do to get actual share of rent in future from today and about arrears.

File a suit for parition and mesne profits. Claim the arrears of rent received in the past 3 years.

I agree with advice of Adv. Archana, also include interest on arrears of rent, Court fee would be around 1% of the amount in claim.
