Respected Sir,
Iam Physically handicapped person(QUADRAPLEGIC).we have Joint Property which came from my GrandFather,my father and his Elder brother,my dad expired in 2003yr and his brother had died long back,my uncle(dads brother)had 1 daughter.In 1992year my father had given money for his Elder brother share to his Babhi as they need money at that time and my dad became the only owner,Entire Records and Passbooks are on my Dad name,before my dad passbooks are on my grandmother name,in Revenue records my dads brother name is not there from many years,after my dad's death records came on my mother name.
In Feb 2012 when we went to pay Land Tax,local persons had told us that my sister(dads brother daughter) is Trying to convert property on her name,As my mother is having b.p & sugar ,she gifted the property to me and my brother by Registering on our name,Last before month we went to Apply PassBook,there VRO told us that for Half of our Property passbook was already issued on my sister name,when we had shown Original Registered Documents which are on our name,VRO and MRO are saying how passbooks are issued on her name,vro who issued that passbook was transferred.They will cancel that passbook shortly.
I want to know how passbooks are issued to my sister,because since from yr1992 records are on my dad name,Now only Half share property passbook are on her name,but Land was Registered on our name,Will she get Rights on our property with that passbook . Our Lawyer is telling us that a)with that passbook your sister cannot get rights on your property b)even if she fights by court,she cannot win the case ,as from many years records are on your family name.c)from 10years why they didn't ask their share if they have rights d) they cannot provide original documents
Advice me what we must do now,shall i approach court saying that my sister is deceiving us.Please Advice Me

Wrong entry in the record do not provide the ownership rights to the person in whose name such wrong entries go on since a long time especially in your case where a time of only 10 years has only elapsed. Only if at the time of giving money to your aunt, the registration of the land was made in favour of your father by your aunt only then you have a legal right to have entire land in your favour otherwise your cousin sister shall have got a legal right to retain her share by way of a civil suit.

I would not like to agreewith any answer.
Entries pertains to your sister,then where from the aunt comes in answer?
Your dads'brother widow claim still survives even if any money was paid to him for his share as no proper deed of relinquishment was made by your dads' brother or by his bhabhee.
Any way entries made in your sister's favor are wrong.
