in feb 2006 I did bayana of property for 31 lakh rupees. He has given me 2,50,000 by cheque. The biana was on 3 ruppes stamp paper and not notarised. bayana date is 1 feb 2006 and last date is dec 2010, 5 years, is this bayana legal. I am the legal hire of property by unregistered will and my step mother is opposite defendent against me..he never showed me the original biana as i signed on blank documents as trusting one of my childhood friend. He hired his own family lawyer for me, He was giving money by cheques many times taking receipt each time. He always threatens me that he has good links with police and gundas. there are 400 cases against him in the chandigarh court. It came even in news papers. I changed the lawyer in jan 2011. than he filled case against me without telling me. I just came to know this case when there was muniyadi on my house last month. date to apear is 4th october 2012.i appointed a lawyer. My question is that he cheated and used forged witness in bayana. I have video and audio proofs against him for last 2 years. my new lawyer is also bribed by him, I dont want to loose my parents proprty. I dont have money to hire a lawyer, i dont know what to do.

Immediately cancel the biana asking him to collect the earnest money.
File a declaratory suit and for injunction to save the property.
Without knowing the details of the case filed against you further advice could not be made on that aspect.

You can go to the Legal Services Authority in your local Sub-Division or State Office, they will provide you lawyers without fees. You should revoke that "Baynanama" by sending lawyer's notice and file a suit for Declaration and Injunction in Civil Court where the property is situated. You can also file a Criminal case in Judicial Magistrate Court.

You have put up multiple querries in one go.
You shall have to engage local lawyer to get expected/probable results and relief.
