Negotiable instrument act

(Querist) 21 December 2012 This query is : Resolved 
if complainant says that accused borrowed money from him and orally states in cross that he arrange the money from his firm? but account books not produced in court and even the witness who was present at the time of payment was also not come in witness box. whether this oral statement is sufficient to prove the case of the complainant? if not then what will be the defence of accused?

Such oral evidence has no value in the eyes of law as the complainant has to establish on the documentary evidence that he had advanced the money mentioned in the cheque to the accused person.
