Rights of son in mothers property

Hello,

our house is in the name of my mother which has been created by my father. Now he wants to sell it. Am I eligible for ask for my share from the sell amount of the house. I also have a sister who is married.

As per Law your mother only deciding authority over her property, so no one obstruct and alienate the property, so your mother only can do any thing, you are not do any claim and hindrance over property.

Since the property is in the name of your mother she has all rights to sell, gift, or make a will about it till she is alive. No one can make a claim in it. After her the legal heirs (Father, sister, brother)will be having equal rights in absence of any will.

Legally you have no right to force your mother to provide any alleged share out of sale proceeds.
