Submit for court order without originals

(Querist) 25 November 2013 This query is : Resolved
Hello Experts,

I'm about to submit documents to Court for a Court Order. I was informed that all the Originals need to be submitted. But I found that there are some documents for which I do not have Originals (not even the photocopy). But I have details for those entities.

Can I still submit for getting Court Order ?

Thanks.

ONLY ORIGINAL WILL BE EXHIBITED.

You have been rightly instructed to submit the original documents alone before the court but in certain exceptions, you may file the photocopy of the documents giving reason that the originals are held by the opposite party, which if admitted by the other side, can be marked as exhibit. However I dont understand your later part of the query stating "But I found that there are some documents for which I do not have Originals (not even the photocopy). But I have details for those entities", what do you mean that I do not have originals and not even the photocopy, so is there a document at all or not?

Hi T. Kalaiselvan,

"But I found that there are some documents for which I do not have Originals (not even the photocopy). But I have details for those entities" - means - we got information about those details from one person from the opposite party but do not have the originals/photocopy.

We are going for RTI Act to get the details of those accounts. Correct approach ?

Yes! That would be correct approach if documents are of public nature?you can even apply for certified copies!
