This query is : Resolved
Please give your opinion that what all in these are harassments?
1. Asking to come of office to work when the person is not well
2. Approving leaves of everyone but not for a particular person only
3. Complaining for only 1 special person for changing his/her technology but this same complaint is not made for others.
I am sorry but I not understood the reply. This is not acedmic query but real life situation currently. The manager wants to harass and doing these things which are not correct atleast not ethical. want to know if they are illegal also or not.
Changing job is easy solution of hard problem. In this case, the particular person wins and continue to do it with others. Others is not my problem and I can leave and become happy but what about others. and there is no guarantee that a person can not be unlucky 2 times.
These 3 are just small tip of iceberg but I thought they are quite wrong legally atleast for human rights. Does they dont violate nay of fundamental rights guarnteed by constitution? If you confirm law is hopeles then yes, changing job is only way.

What is the facts, looks like academic query.
The harassment can not depend on mere situations if the background is not properly checked.

1.One who is not well should apply for medical leave with doctor's certificate of illness and should join with fitness certificate. There is no other legal course.
2.Although not legal but hard to prove or to look for a legal remedy.
3.A wrong with no practical remedy better change the company.

It is very easy to advise to change the company but practically it is very difficult to get a new one; If the Manager is appearing to torture you continuously, take up the matter with the higher official above him for necessary relief with sufficient evidences to narrate the Manager's woes against you.

In private sector it is not easy to survive if your boss is unhappy. This is practical situation. Either leave the job or manage your boss. Legal battle would not fetch better results than managing your boss which is easier also.

Right now there is no proper law in place to redress your grievance.

A lot of confusion you own.Fundamental rights are enforceable against state and their executives.
In a relation of employer and employee only
labor laws or service agreements would be looked into.
If a manager misbehaves and commits crimes punishable under IPC then an FIR is required.
If a manager harrashes then TOP management should be kept apprised.Much depends on company and it's HR dept.

What according to one expert looked like 'an academic query' - has been discussed by other experts as they did not treat it as academic query.
Thanks.

we have advised you at length . let all aggrieved employees join hands and complain against said manager to his seniors . if company does not take action leave the organisation
