Hello ALl,
My wife has filed 498A 3&4 against me and my family in the month of May.Now Chargesheet has been filed only I have received the summons from Police ,they have said my parents and my sister name has been removed.My first hering date is on 21/04/2014.
Now anyone can tell me that what my wife and my lawyer do right now?
1.can they apply for reinvestigation at this stage if it so ,what are the possibilities?
2.Can they ask police to file amended charagesheet?
3.During trial whether can they ask my parents name has to be included?If they do so,how much strong the case is?
4.As I told in my previous queries ,My wife and her father they have arrested remanded in Jail for 10 days later released on Bail based on cyber crime complaints total 13 nos.For morphing my sister ,mother and mine in to nude body publishing in Facebook and pornograpic websites.
Arrested under IT ACT 66A,67A & sec 4 TNHWA
And am also am having her medical reports which I I have treated her for physcological diseases and her accepted too all the statements am having.
Please tell me how much storng case is from my side once i receive official copy of chargesheet whether I can go for Quasing ?Within How many days Can I go for quasing?

advisable to contest case on merits . consult a local lawyer . it is necessary to go through charge sheet filed by cops in court to advise .

Chances for Quashing of charge sheet are bleak but for concrete opinion charge sheet need to be seen. Better defend your side, take help of some senior lawyer expert in criminal law.
