Claim compensation under mact to insurance company

(Querist) 28 March 2014 This query is : Resolved
I need a advice to go ahead to claim insurance under motor Accident claim tribunal(MACT) against insurance company. My brohter had an accident while driving his car as cas fell in pit about 200 ft and died at spot. Car is fully insured as driver, passenger, owner and third party as well. since he was the owner and driving the car himself at the time of accident wherein each has life cover upto 2 lacs as per policy document. I need a advice whether can we claim the same insurance company from which the vehicle and life was insured for the compensation is calculated on the basis of the life expectancy of the deceased multiplied by his income even as per policy document owner cover upto 2 lacs only.

looking forward to your valuable response.

Insurance document does not limit the liability of the insurer in third party liability cases.

In the case in hand, for the death of the owner/ driver of the car, claim can not be awarded above the amount insured by the policy.
Hence NO is simple answer to your query.
