Civil case reg. false affdavit

In civil suit plaintiff files false affidavit,false documents ,
1- should I file application u/s 304 in the same court as case is pending.
or
2- should I have to file u/s 200 in criminal court.pl advice

in your reply you should mention that plaintiff has fabricated documents and false averments have been made on oath . dont file any applications under section 340 at present

If there is any false statement or affidavit on oath, produced by party before civil court or any court then the opposite party may file a complaint u/s 340 of Cr.p.c before the court where the matter is pending.

Only after establishing that the affidavit and the documents filed are false, you have a right to sue by moving an application u/s 340 as intended by you, so you have wait to establish it.
