Hello,
please let me know the procedure for obtaining of claim form settled by Bank in favour of concubine. I am the legal heir and Bank is not giving any information.
I have strong evidence of having deposits with Bank i.e. We have filed for partition suit and we got information from income tax officer about the IT returns certified copy obtained from court

Since you are the legal heir you may write finally to Chairman,MD with a copy to Governor RBI and peruse if required the RTI route.
Bank may also yield to legal notice.
Otherwise the court can order to produce it.

Use RTI process as Legal heir of the deceased if it is Public Sector Bank.
May call the Banker for evidence through summon procedure.

You are legal heir of the deceased depositor to your satisfaction. But how the bank can trust your oral version that you are legal heir of the deceased depositor. In the absence of nomination, you have to obtain succession certificate from civil court. Unless and until you prove that, you are the only legal heir of the deceased depositor, the bank may deny any request under Right to Information Act 2005. While applying for succession certificate, please ensure that all the other legal heirs of the deceased depositor as well as the bank concerned are made parties to the application. If the deceased depositor has given nomination in favour of his concubine, then the concubine may be joined as second respondent with the bank concerned.

Agreed with experts that you can call for the records either through RTI ac or through process of summons from court.
