change of user / change of bussiness

im from kerala.im running a mens textile shop . i want to change the bussiness to a mobile shop.landlord has filed eviction petiton in the court.so i will not get the consent from landloard to change the bussiness.is there any problem to start the mobile shop legally as i am a statutory holding over tenant

if i change the name of the shop from textile to mobile ..is there any problems legally.the rent deed is expired any we are continuing as holding over tenant.

generally the change in the nature of business should not affect the tenancy terms unless it is specifically mentioned in the terms or it is harmful or against some of the clauses.. talk to the owner and get it settled.

If the Rent agmt. is in Individual name and there is no mention of the business to be carried on in such tenanted premises , then there is nothing to worry.However,before starting any new venture , it is always advisable to settle tenancy dispute with the landlord in an amicable manner .
